What is Mediation?

Mediation is a trusted and proven method of resolving disputes between two or more parties. The role of the mediator is that of a neutral third party, who facilitates communication to help the parties reach a mutually agreeable solution. Throughout the process, our experienced mediators help parties explore and frame issues, define problems, find common ground, manage expectations and find viable solutions.

Participation in mediation is a voluntary process and is kept private and confidential keeping what is discussed and the terms of the agreement strictly between those involved.  Unlike the court or arbitration process, only the parties can bring the dispute to a resolution, with creativity and control over the solution and less risk. Once a resolution has been reached the mediator will help the parties draw up the mediation agreement.

Mediation is available at any time and effective at any point during a dispute. In some cases, it is best to embark on the process as early as possible. In other cases, it is only when the prospect of the expensive, stressful, and drawn-out process of litigation becomes a reality that parties will seek an alternative way to settle a dispute.

Mediation will generally take at place in a neutral venue. At ClearSky ADR we work with the parties and their representatives to find a suitable venue depending on the nature of the dispute.
